Brewtendo Network: Terms of Service

1. What These Terms Cover
These Terms of Service ("Terms") govern your use of Brewtendo Network ("Brewtendo," "we," "us"), including:
- The Brewtendo Network ID ("BNID") account system
- The 3DS eShop-equivalent service
- Badge Arcade
- The Friends List service
- SpotPass
- The Nintendo Video applet content-delivery service
- Brewverse, our social platform (formerly referenced internally under Nintendo's "Miiverse" name, though we do not use that branding publicly)
- The Brewtendo Discord community and its bot ("BrewBot")
and any other current or future Brewtendo services.
Brewtendo Network is not affiliated with, endorsed by, or sponsored by Nintendo Co., Ltd. or any of its subsidiaries. References to Nintendo services, hardware, or applet names (e.g., "the Nintendo Video applet") describe what our services interoperate with on your existing hardware, and are not claims of ownership over those names or products.
Brewtendo Network is a free service. If you paid someone for access, that transaction was not with us, and any dispute over payment should be raised with whoever charged you.
2. Eligibility
- You must be 13 years or older, or meet the minimum age for social-media-equivalent services in your jurisdiction, to create a BNID.
- Age is self-reported at signup. We do not independently verify age at the point of registration (see Section 8 for what happens if an account is later found to be underage).
- You may not create a new account if you have been previously banned from Brewtendo Network.
3. Account Responsibility
- You are responsible for keeping your password and account credentials confidential, and for all activity that occurs under your account.
- If you believe your account has been compromised, notify us immediately at [email protected] or [email protected].
- Brewtendo Network is not liable for loss or damage resulting from unauthorized access to your account caused by your own failure to secure your credentials (for example, sharing your password or reusing it elsewhere). This does not limit any responsibility we have for losses caused by a failure on our part to safeguard account systems.
- You must provide accurate information at registration and keep it up to date.
- Accounts are for personal, non-commercial use. You may not sell or transfer your account.
4. User Content (Brewverse and elsewhere)
- You retain ownership of content you post (posts, drawings, comments, messages).
- By posting, you grant Brewtendo a non-exclusive, worldwide license to display, store, and otherwise handle your content as needed to operate the services.
- You are solely responsible for what you post. Brewtendo Network is not responsible for user-generated content, and content posted by a user reflects that user's own views, not ours.
- You may not post content that is illegal, sexual in nature involving minors, or otherwise violates child-safety laws, and may not use the service to harass, threaten, or abuse others.
- We operate a reporting and moderation system (see Section 9). Getting moderated for content you posted is your responsibility, not ours.
5. Moderation
- Automated (AI) moderation actions are provisional. When automated moderation takes an action (removing content, restricting an account, etc.), that action is a hold pending human review, not a final decision. Staff review automated actions when available and make the governing decision.
- Staff decisions are final in the sense that a single staff decision is not subject to indefinite re-litigation. See Section 8 for the one specific appeal path that exists (age-related restrictions).
- When your account is banned or restricted, you will be notified that the action occurred. We may or may not disclose the specific reason for the action, at our discretion, except where Section 8 requires it.
6. Data Deletion Requests
- If you want your account or associated data deleted, email [email protected] or [email protected]. We do not process deletion requests automatically. Deletion is performed manually after we receive and verify your request.
- Do not submit data deletion requests through Discord. We require a written, retained record of deletion requests, which a Discord message (that can be deleted or edited) does not reliably provide. Requests made via Discord will not be processed, and repeated attempts to do so may result in a warning.
7. Discord Community and BrewBot
Our Discord server and its bot, BrewBot, are part of Brewtendo Network and subject to these Terms in addition to Discord's own Terms of Service.
- Automated moderation: BrewBot automatically filters messages, nicknames, and thread names for a defined set of disallowed terms, including attempts to evade the filter (lookalike characters, spacing tricks, etc.). Detected violations may result in message deletion, nickname reversion, or thread renaming without prior warning.
- Error-code lookup: BrewBot scans messages for recognized error-code patterns and may reply with relevant support information. This is provided as-is and is explicitly experimental, and accuracy of any error-code information is not guaranteed.
- Support email bridge: incoming support emails may be relayed into a designated support channel for staff visibility. Sender addresses are partially masked before posting, but subject lines and message bodies are shown to staff who can access that channel.
- Staff commands: designated staff roles have access to moderation and account-management commands within the server. These are for staff use in operating the community and are not user-facing features.
- Standard Discord conduct rules apply in addition to anything BrewBot enforces; violations may result in server-level bans independent of any Brewtendo Network account action, and vice versa. A Discord ban does not automatically mean a BNID ban, and a BNID ban does not automatically mean a Discord ban, unless the underlying conduct affects both.
8. Age Restriction Process
- If an account is identified as belonging to someone under the minimum age for their region, the account is restricted (not deleted) from certain features. Restricted accounts follow the standard retention policy. See the Privacy Policy for details.
- You will receive a one-time email notice at the time of restriction stating what is restricted and the reason. If you attempt to use a restricted feature afterward, you may receive a reminder email; this is capped at once per day regardless of how many attempts are made in that period.
- This restriction may be appealed exactly once. To appeal, reply to the notice or email [email protected] / [email protected]. As part of the appeal, we will ask a parent or guardian to email us confirming their relationship to you and your actual age or birthdate.
- We review the appeal, including the parental confirmation, and make a final decision: the restriction is lifted, upheld, or, if we believe the parental confirmation was fabricated or the appeal was made in bad faith (e.g., a user impersonating a parent), the account may instead face a separate, harsher, and non-appealable action.
- This process is a good-faith verification effort, not a guarantee of accuracy; we cannot fully prevent someone from providing false information during an appeal, but doing so is itself a violation of these Terms.
9. Suspension and Termination
- We may suspend or terminate accounts for violations of these Terms or other posted rules.
- Terminated accounts lose access to all associated Brewtendo Network services and content.
- We are not obligated to disclose the reason for a termination, except as described in Section 8 for age-based restrictions specifically.
10. Limitation of Liability
- Brewtendo Network is provided "as-is," without guarantee of uninterrupted access or availability.
- Brewtendo Network is not liable for data loss, account access issues, or other damages related to your account, except to the extent caused by our own failure to meet obligations described in these Terms.
11. Governing Law
These Terms are governed by the laws of Canada, without regard to conflict-of-law principles, given that Brewtendo Network's servers and operations are based there.
12. Changes to These Terms
We may update these Terms at any time. Continued use of your account after changes take effect constitutes acceptance of the updated Terms.
